RAJA’S FASHIONS:
PERSONAL DATA PROTECTION POLICY FOR CUSTOMERS AND CLIENTS

This Personal Data Protection Policy for Customers and Clients (“Policy”) explains how Raja’s Fashions (“Raja’s Fashions”, “we”, “us”, or “our”) collect, use, disclose, transfer, and otherwise process (“process” or “processing”) your Personal Data in the course of our business, in accordance with the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”).

We advise you to read this Policy in its entirety.

1. When does this Policy apply to you?

This Policy applies to you if you are a customer or client of Raja’s Fashions, whether former, current, or prospective, and website visitors (“Client”), as well as any persons whose Personal Data is provided to us by the Client, such as relatives or other contact persons (“Associated Person(s)”).

2. What types of Personal Data does Raja’s Fashions collect from you?

(a) General Personal Data: Raja’s Fashions collects various types of your Personal Data which can be used to identify you, either directly or indirectly (“Personal Data”), including your full name, nickname, contact address, present company and address, telephone number, mobile phone number, office phone number, personal email address, office email address, residential or mailing address, date of birth, age, gender, nationality, picture (photo), order history, including the date and time of your order, clothing and fabric preferences, measurements, internet protocol (IP) address, operating system, browser type, geographic location, information on the website which lead you to our website, including any other Personal Data, which you may voluntarily provide to Raja’s Fashions during the process prior to becoming a Client of Raja’s Fashions and while you are a Client of Raja’s Fashions, as well as any Personal Data that Raja’s Fashions may need to collect from you in connection with your order, purchases, and use of our services.

(b) Sensitive Personal Data: Raja’s Fashions collects certain categories of your Personal Data which are considered as sensitive personal data pursuant to the PDPA, including weight, and height, as may be specified in your measurements (“Sensitive Personal Data”).

(c) For any Client whose age is below 20 years old, you represent and warrant that your parent or legal guardian (“Legal Guardian”) has been provided with this Policy and that the Legal Guardian has thoroughly read and agreed to the terms of this Policy. In addition, where the processing of your Personal Data requires consent as a legal basis, you agree to be responsible for obtaining consent from your Legal Guardian using the form prescribed by Raja’s Fashions and promptly provide Raja’s Fashions with the duly signed consent form.

(d) Raja’s Fashions also collects the Personal Data of your Associated Person(s), whereby the Client warrants that the Client has informed the other person(s) about the information in relation to the processing of the Personal Data under this Policy and obtained proper and informed consent from such person(s) (if required), or that the collection and disclosure of the Personal Data of such persons can rely on other lawful legal basis for providing the Personal Data of other person(s) to Raja’s Fashions.

3. Why does Raja’s Fashions collect and process your Personal Data?

(a) Consent:

a. Raja’s Fashions processes Personal Data and Sensitive Personal Data of the Client as described in this Policy for various purposes, including, without limitation, to allow you to purchase our goods and services, communication and making appointments, customer support, managing our relationship with you, performance statistics and to better improve our services, executing payments, and marketing purposes.

b. Where we process your Personal Data for marketing purposes, such as by sending you our newsletters about our products, services, or promotions, you may withdraw your processing for direct marketing purposes at any time by using the “unsubscribe” link provided in each communication and/or contacting us at the address provided in Article 10. c. The Client or Associated Person may withdraw his/her consent at any time, subject to the conditions under the applicable laws. Withdrawal of consent will not affect any processing of your Personal Data for which you have lawfully provided consent prior to such withdrawal.

(b) Contractual Necessity:

a. Raja’s Fashions processes Personal Data of the Client in order to allow you to purchase (or considering purchasing) our products and services and so that we may provide our services to you. This includes, without limitation, to allow you to register on our website, make an appointment with us, purchase our goods and services, execute payments, and for us to provide customer support.

b. Where the processing of Personal Data relies on contractual necessity as a legal basis, failure to provide required or necessary Personal Data may result in Raja’s Fashions being unable to perform its obligations under the purchase agreement, or to proceed with any of the Client’s requests in relation to purchase of our goods and/or services, either in part or in whole.

(c) Legal Obligation:

a. Raja’s Fashions processes Personal Data of the Client to comply with any and all other applicable laws or regulations, and to comply with any order of the court, competent authorities, and/or government agencies. These include, without limitation, processing of Personal Data of both the Client and Associated Persons in relation to their request to exercise rights under the applicable data protection laws and regulations.

b. Where the processing of Personal Data relies on legal obligation as a legal basis, failure to provide required or necessary Personal Data may result in Raja’s Fashions being unable to perform its obligations or duties as a service provider, either in part or in whole, or it may cause Raja’s Fashions and/or the Client to be in violation of applicable law or regulation, or order of the court, competent authorities, and/or government agencies.

(d) Legitimate Interest: Raja’s Fashions processes Personal Data of the Client in order to provide support and facilitation to the Client, including without limitation, to arrange for payment and issuance of invoice to the Client.

(e) Legal Claims: Raja’s Fashions processes Personal Data of the Client when it is necessary for the establishment, compliance, exercising, or defense of legal claim by Raja’s Fashions.

4. Where does Raja’s Fashions collect your Personal Data?

(a) Client: We normally collect your Personal Data directly from you before, during, and after the provision of our services to you.

(b) Associated Persons: We collect your Personal Data from the respective Client.

5. To whom does Raja’s Fashions disclose your Personal Data?

(a) Raja’s Fashions discloses Personal Data of the Client to our staffs and vendors, both within and outside Thailand, for purposes of fulfilling your orders and the purchase of our goods and/or services.

(b) Raja’s Fashions may disclose Personal Data of the Client to third parties in the circumstances where the Client has given consent to such third parties to contact the Client.

(c) Raja’s Fashions discloses Personal Data of the Client to any person or entity who provides manufacturing, administrative, telecommunications, computer, information technology, or other services to Raja’s Fashions in connection with Raja’s Fashions business operations, including, without limitation, tailors, suppliers, vendors, auditors, accounting firms, payment service providers, and delivery service providers.

(d) Raja’s Fashions may disclose Personal Data of the Client to its business partners and tailors.

(e) Raja’s Fashions may disclose Personal Data of the Client to any other persons or entities to whom Raja’s Fashions is required to make disclosure by applicable law or in response to an order of the competent authorities, government agencies, and/or courts, both in Thailand and overseas.

6. Where does Raja’s Fashions transfer your Personal Data?

(a) We transfer your Personal Data to third parties (e.g., service providers, vendors, tailors, and payment platforms such as PayPal), which are generally located in Thailand. In certain circumstances, such third parties may be located outside Thailand, and such jurisdictions may have different data protection standards to those prescribed by the data protection authority in Thailand. Notwithstanding that, we ensure that we will protect your Personal Data by implementing adequate personal data protection standards for the transfer of your Personal Data outside Thailand. We will also ensure that any entity to whom your Personal Data will be disclosed will implement adequate personal data protection standards,

(b) The transfer of your Personal Data to third parties outside Thailand is generally for the purposes relating to our ability to provide goods and services to you, business operations, and payment executions.

7. For how long does Raja’s Fashions retain your Personal Data?

Raja’s Fashions will retain Personal Data of the client for the entire time that you remain our customer or client, and for a period thereafter as required for business operation purposes, unless we are required or permitted by applicable laws to retain your Personal Data for a longer period. Personal Data of the Associated Person will generally be retained for the similar period as Raja’s Fashions will retain Personal Data of the Client who is related to such Associated Person. Where we process your Personal Data in connection with a legal obligation, your Personal Data will be retained for the duration of the prescribed legal retention period, as stipulated under the applicable law. Where we process your Personal Data solely with your consent, your Personal Data will be deleted, destroyed, or de-identified, subject to the requirements and conditions prescribed by the applicable law.

8. What are your rights in relation to your Personal Data?

You are entitled to:

(a) Request to have access to and obtain a copy of your Personal Data, and to request the disclosure of the source of the Personal Data, in the event that your Personal Data was collected without your consent;

(b) Receive your Personal Data in a commonly used and machine-readable format (if any), and to have your Personal Data in said format transmitted to another Data Controller;

(d) Object to the collection, use, and disclosure of your Personal Data;

(e) Request that the processing of your Personal Data be suspended;

(f) Request that your Personal Data be corrected, updated, or completed;

(g) Withdraw your consent at any time, provided that there is no other legal ground for Raja’s Fashions to continue with the processing of your Personal Data; and

(h) Lodge complaints to the Office of Personal Data Protection Commission and any other competent authorities.

Your request may be refused, and the exercise of your rights is subject to the conditions and limitations prescribed by law.

9. Changes to this Policy

Raja’s Fashions may amend, change, or update this Policy from time to time, whereby Raja’s Fashions will notify you about such changes via your selected communication channel or any other communication channels as Raja’s Fashions deems appropriate. In the event that the amendment, change, or update will affect the purposes for which your Personal Data has originally been collected, Raja’s Fashions will notify you about such changes and obtain your consent (if applicable), prior to such changes becoming effective.
